HOSTIQ USER AGREEMENT

This User Agreement (“Agreement”) is entered into between MySoftware LLC, a Florida limited liability company (“Company,” “we,” “us,” or “our”), and you, the user of the HostIQ software (“you” or “User”). By accessing or using HostIQ, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree to the terms herein, do not use HostIQ.
1. Overview of HostIQ
HostIQ is a subscription-based software product that provides analytics, dashboards, and business intelligence tools for short-term rental (STR) property managers. The platform relies on integrations with external Property Management Systems (PMS) to retrieve and display booking and property data.
2. Free Trial
Each new User is entitled to a 180-day free trial, starting from account registration.
After the trial period, Users must purchase a paid subscription to retain access.
If a subscription is not initiated by the end of the trial, access to HostIQ and all associated data will be terminated.
3. Subscriptions and Billing
Users may choose between:
- Monthly subscriptions (billed every 30 days), or
- Annual subscriptions (billed every 365 days).
Subscription fees are based on the number of properties under management and are posted on our website.
All payments must be made via credit card. A 2% processing fee is applied to all transactions.
By providing payment details, you authorize MySoftware LLC to charge recurring fees based on your selected plan.
4. Cancellation and Termination
You may cancel your subscription at any time through your account dashboard.
Upon cancellation:
- Access to the HostIQ platform is immediately revoked.
- Monthly subscribers will be charged a pro-rated final payment.
- Annual subscribers will be billed through the end of the month in which they cancel.
We do not offer refunds for unused periods.
All data is deleted following a brief grace period unless requested in writing at the time of cancellation.
5. PMS Dependency
HostIQ requires an active connection to a supported PMS to function.
If you discontinue your PMS or fail to connect a compatible provider, HostIQ will not be usable.
Switching PMS providers requires re-authentication and API reconfiguration by you.
Changing PMS providers may result in the loss of all historical data previously stored in HostIQ.
We assume no responsibility for data availability, completeness, integrity, or loss resulting from PMS changes, disconnections, or limitations.
6. Data Ownership, Access, and Responsibility
All data displayed in HostIQ is retrieved from your PMS. You are the sole owner of that data.
HostIQ acts only as a conduit and display layer. We do not store or validate the accuracy, integrity, or completeness of your data.
We do not back up your data. It is your responsibility to retrieve, export, or store any data from HostIQ before canceling your subscription.
If you wish to download your data after canceling, you must submit a written request at or before the time of cancellation. Otherwise, it will be permanently deleted within 7 business days.
7. Suggestions, Recommendations, and Automated Insights
HostIQ may generate performance summaries, projections, or suggested actions based on data trends.
All recommendations and insights are suggestions only and are not guarantees or promises of results.
You agree that any decisions you make—financial, operational, or otherwise—based on information in HostIQ are made entirely at your own risk and discretion.
8. No Warranties or Guarantees
HostIQ is provided on an “AS IS” and “AS AVAILABLE” basis.
We make no representations or warranties of any kind, express or implied, regarding:
- The accuracy, reliability, or timeliness of data displayed;
- The fitness of the platform for any particular purpose;
- The outcome of any business decision, action, or inaction taken using or in reliance on the platform.
9. Limitation of Liability
To the fullest extent permitted by law, MySoftware LLC shall not be liable for any damages of any kind arising out of or in connection with:
- Your use or inability to use HostIQ;
- The accuracy or completeness of any data or recommendation;
- The performance, profitability, or outcome of any STR properties you own or manage;
- Loss or corruption of data, loss of business, profits, or goodwill;
- Any action or omission taken by you based on HostIQ suggestions.
This includes but is not limited to direct, indirect, incidental, consequential, special, exemplary, or punitive damages, even if we were advised of the possibility of such damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless MySoftware LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees and costs) arising out of or in connection with:
- Your use of the HostIQ platform;
- Your STR business practices and decisions;
- Any alleged or actual violation of this Agreement;
- Any action you take (or fail to take) based on data, analytics, or recommendations generated by HostIQ;
- Your integration or disconnection from any PMS platform.
11. Modifications
We reserve the right to modify this Agreement or HostIQ’s features and pricing at any time. Notice of material changes will be provided via email or through the platform. Continued use after changes become effective constitutes acceptance of those changes.
12. Governing Law
This Agreement is governed by the laws of the State of Florida. Any dispute shall be resolved exclusively in the state or federal courts located in St. Johns County, Florida. You consent to the jurisdiction and venue of such courts.
13. Entire Agreement
This Agreement constitutes the entire agreement between you and MySoftware LLC regarding your use of HostIQ and supersedes any prior or contemporaneous agreements or communications.
